If an order has an open encumbrance on an inactive (annual) budget - that is, a budget whose Valid To date has passed - can we still invoice against that budget?

Resolution:
No, you can't create an Invoice (INV) transaction on an inactive budget, even though there is still an inactive budget. You will have to open the next year's budget and move the encumbrances forward. Then you can invoice against the current budget year.
